These terms are the agreement between you and Franco Caviglia (“Klaky”, “we”, “us”) for using the Klaky app and this site. By creating an account or using the app, you accept them. If you don’t agree, don’t use Klaky.
1. What Klaky is
Klaky helps you record your business’s social media videos: it writes the script with artificial intelligence, guides you through each shot and edits the video. For now, it works on Android phones.
2. Your account
- You sign in with your Google account. You’re responsible for what is done with your account.
- You must be at least 18 years old and, if you use Klaky for a business, be able to act on its behalf.
- You can delete your account at any time from Delete my account.
3. Plans and payments
- Free: 2 videos in total, which don’t renew. They carry the “Made with Klaky” watermark.
- Paid plans: monthly or annual subscriptions with a number of videos per month. Prices are shown in the app and on Google Play, which charges them and converts them to your currency.
- What counts as a video: each script you generate. Regenerating parts of the script, up to the maximum the app shows, or retaking shots doesn’t count. Videos you don’t use don’t carry over to the next month.
- Renewal and cancellation: the subscription renews automatically until you cancel it from Google Play. Deleting the app or the account doesn’t cancel it.
- Founder plan: the price stays fixed as long as the subscription remains active. If you cancel it, you lose it and it can’t be recovered.
- Refunds: they’re governed by Google Play’s policies.
- If we change the price of a plan, we’ll let you know before it applies.
4. AI-generated content
The scripts are written by an artificial intelligence model based on your business details. They may contain errors or phrases that don’t fit what you sell. Review them before you record and post: you’re responsible for what you post, including prices, promotions and what you say about your products. If a script seems inappropriate to you, report it from the app.
5. Your videos are yours
The videos, takes and texts you make with Klaky are yours. You give us permission to process them only to provide the service to you, for example to edit your videos. We don’t publish them or use them for anything else without asking for your permission.
Make sure you have the right to use what appears in your videos, such as other people’s likeness, music or third-party brands.
6. What you can’t do
- Use Klaky for content that is illegal, misleading or discriminatory, or that infringes the rights of others.
- Try to access other people’s accounts or data, or interfere with how the service works.
- Get around the plans’ limits or resell the service without an agreement with us.
If these terms aren’t followed, we may suspend or close the account.
7. The service
We work to keep Klaky running at all times, but it may have outages or errors. We may add, change or remove features. If a change affects what you paid for, we’ll let you know in advance.
8. Liability
To the extent permitted by law, we aren’t responsible for the business results of your videos or for indirect damages arising from the use of Klaky. Nothing in these terms limits the rights granted to you by Argentina’s Consumer Protection Law (Ley de Defensa del Consumidor).
9. Changes to these terms
If we change anything important, we’ll let you know in the app or by email before it takes effect. If you keep using Klaky afterward, you’re deemed to accept the changes.
10. Governing law
These terms are governed by the laws of the Argentine Republic. In the event of a dispute with a user, the ordinary courts of the user’s domicile have jurisdiction.
